In 2001 the Law Commission found that the time limitations for reporting child abuse claims were not in the best interests of the victims, who in many cases we’re so traumatised that it took many years before they could bring themselves to make claims against their abusers.

According the Law Commission , it could also be argued that the public interest in protecting the defendant from stale claims, and in ensuring that there is an end to litigation. does not apply where the defendant has been guilty of sexual abuse.

The Commission therefore recommended that its proposed long-stop Limitation period of 10 years should not be applied to claims in respect of
personal injuries to the claimant and gave these recommendations to the Government.

In July 2002, Lord
Irvine, announced that the Government had accepted the Commission's recommendations in Principle yet over the following years, no legislation has been brought forward.

At the end of last year, the Government confirmed that the report was amongst the many Law Commission reports still awaiting Legislation.

It seems to me that the government should at least explain why further action on this matter appears to have halted. It simply beggars belief to think that there are abusers who will not be brought to justice because of the Government's inertia.
